Terms of use

1. What you are agreeing to

These terms govern your use of MediTime Pro (the App), supplied by (we, us). By using the App you agree to them.

2. What the App is

The App records the times at which you tell it that doses of paracetamol or ibuprofen have been taken, for up to five people, and shows the time until the next dose would be due under the standard packet limits. It is a record and timing aid. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for the advice of a doctor or pharmacist.

3. Your part

The App depends on you recording doses accurately and at the time they are taken. You are responsible for the doses you give, and for reading the packet. Where more than one person is caring for the same individual, you are responsible for agreeing between you who records doses.

4. Availability and errors

We aim to keep the App working correctly and to correct faults we are told about. We do not warrant that it will be uninterrupted or free of errors. If you find a fault, please tell us using the contact details on the Device information screen so that we can investigate it.

5. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded. Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015, including your right to receive digital content that is of satisfactory quality, fit for purpose and as described.

Subject to that, we are not liable for losses that were not foreseeable at the time you started using the App, or for business losses.

6. Your data

Dose records are stored on your own device and are not sent to us. What we do hold in connection with your purchase, and why, is set out in our privacy information.

7. Changes

We may update the App and these terms. If the terms change materially you will be asked to read and accept them again before you continue.

8. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may bring proceedings in your own courts.

Not final. Under Path B this page is document 09 of the technical file and it is also the contract with every paying customer. It needs a solicitor's review before release, as already planned. Section 5 has been rewritten because the previous blanket exclusion of all liability was unenforceable against a consumer and reads badly for a medical device manufacturer, but that judgement is the solicitor's to make, not mine. Sections 4 and 6 also need checking against your actual refund and privacy position.
